Terms of Service

1. Agreement to Terms

By downloading, installing, or using Focalify (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App on iOS, iPadOS, macOS, watchOS, and visionOS platforms.

2. Description of Service

Focalify is a focus timer and productivity application that helps users:

• Track focus sessions with customizable timers
• Monitor productivity statistics and progress
• Sync data across Apple devices via iCloud (optional)
• Set and achieve daily and weekly focus goals
• Access various timer visualization styles
• Utilize Pomodoro technique features

3. License and Usage Rights

Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial use.

Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or redistribute the App
• Remove or alter any proprietary notices or labels
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any services or systems

4. User Accounts and Data

No Account Required: The App does not require you to create an account. All data is stored locally on your device.

iCloud Sync: If you enable iCloud sync, your data will be stored in your private iCloud container. You are responsible for maintaining the security of your iCloud account.

Data Responsibility: You are responsible for backing up your data. While we use iCloud for sync, we are not responsible for any data loss.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to interfere with the proper functioning of the App
• Introduce viruses, malware, or other harmful code
• Attempt to access areas of the App not intended for users
• Impersonate any person or entity

6. Intellectual Property Rights

The App and its original content, features, and functionality are owned by Focalify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, and logos used in connection with the App are trademarks or registered trademarks of Focalify. Other trademarks, service marks, and logos used are the property of their respective owners.

7. Apple App Store Terms

These Terms are between you and Focalify only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

8. Updates and Modifications

App Updates: We may release updates to improve functionality, fix bugs, or add features. Updates may be required to continue using the App.

Terms Modifications: We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email (if provided). Continued use of the App after changes constitutes acceptance of the modified Terms.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any data or information provided by the App.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FOCALIFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless Focalify and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. You may also terminate these Terms by deleting the App and all copies from your devices.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Focalify is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, or through the courts of competent jurisdiction in our registered location.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Focalify regarding the App and supersede all prior agreements and understandings, whether written or oral.
